Procedure to clear vehicle from customs:

The Importer/Broker will prepare the warrant Customs Declaration Form using the invoice and Bill of Lading.

Once the warrant has been submitted to the transit shed a valuation officer will examine the vehicle to verify the cost of vehicle, and the quantity and type of refrigerant.

The next step is collecting the Environmental Levy form from the Environmental Protection Unit. Waiver of Environmental Levy is determined based on the age of vehicle.

Once payment has been made, the Importer/Broker will take the warrant to be stamped by the Port Authority, which is located at Deep Water Harbour. The warrant is then taken by the Importer/Broker to the Deep

Water Harbour Transit Shed, where the Customs Officer will verify the payment was made, the documents are then stamped and release to port authority, which is responsible for releasing the vehicle from the port.

VAT-15% of the total value of the vehicle.

Customs Duty- utmost 60% depending on the CIF of the vehicle.

Halifax and Vancouver are major ports for importing Japan used cars in Canada.

Age Restriction:

Importation of used vehicles with more than 15 years old is restricted in Canada.

Left-Hand Drive Vehicles:

Importation of left-hand drive vehicles is permitted in the Canadian country. Vehicles drive on the righthand side of the road.

Before importing your vehicle:

The first thing you need to do is find out whether the car you’re importing is even importable into Canada. Many cars destined for the US market do not meet Canadian safety standards (especially newer ones), and are therefore not importable at all. Note specifically that the person at the border was quite surprised that my MR2 was acceptable it seems that many late model Toyotas do not qualify. Transport Canada has an agreement with a private firm, Livingston International, which is now operating as the Registrar of Imported Vehicles. If you call them, and give them the year, make, and model of vehicle, they will tell you whether the car is legally allowed to be imported into Canada.

Documents Required:

Original Title, Manufacturer’s Statement of Origin or Certificate of Origin (front and back). Should your vehicle not be required to have one of these documents, then you must provide a certificate of No Title.

Bill of Sale

Copies of the Export Certificate and Invoices

Importing A Non-Regulated Vehicle:

Some vehicles are defined as non-regulated, which makes them exempt from having to comply with the Motor Vehicle Safety Act when they are manufactured or imported.

Vehicles have non-regulated status based on their:

Design characteristics

Circumstances at time of entry into Canada

Age of the vehicle

Examples of Non-Regulated Vehicles:

Vehicles 15 years old or older according to their manufacture date

Buses manufactured before January 1, 1971

Vehicles brought in temporarily by visitors, foreign students or foreign workers

Vehicles designed strictly for off-road use such as farm tractors, construction equipment and utility-terrain vehicles (UTVs)

Competition vehicles designed only for closed course competitions, with the necessary labels

Power-assisted bicycles, as defined in section 2(1) of the Motor Vehicle Safety Regulations

Import Procedures for Non-Regulated Vehicles:

Verify the vehicle’s non-regulated status

Inspect for possible soil contaminants

Examine the ownership documents

Collect taxes and/or duties if applicable

Decide admissibility according to other Canadian customs regulations that may apply

If the car is acceptable, you will also need the following paperwork:

US Title to the vehicle

Bill of sale/transfer of ownership

In addition, you will need a written notice from the manufacturer of the vehicle (NOT just a dealership) stating that any recalls that may be in effect have been performed on the car you’re planning on importing.

Also note that if the car is newer than the 1990 model year, you will be expected to have the car retrofitted with the equivalent of the Canadian Daytime Running Light system.

Choose the right car

You should be aware that it has to comply with Canadian import laws there is the import regulation for all cars being imported into Canada.


The imported vehicle must meet the requirements of Canada Board Service Agency (CBSA). vehicles manufactured outside Canada, the US, or Mexico are assessed duty at the rate of 6.1%.
Once you get the invoice, you can print it out and bring it to your local major bank to transfer money to their bank account. Make sure to have the receipt of your payment at your bank as it is proof of your money transfer and you can submit it to your supplier for their quicker confirmation.

Shipment Delivery

Once your payment is acknowledged by the supplier, the shipment procedure can be started. It is depending on the condition of payment between you and supplier.

But, most of the case, the supplier required to have the full payment prior to the shipment delivery.

Port clearance and custom clearing

Before the car arrives, you have to find the local port clearing agent who is specialized port clearing company to handle your car from port and custom clearing.

Left/Right Hand Drive:

Both Left Hand drive and Right-Hand drive vehicles are allowed to be import in the country.

Importing a Motor Vehicle:

Warning

Imported motor vehicles are subject to safety standards under the Motor Vehicle Safety Act of 1966, revised under the Imported Vehicle Safety Compliance Act of 1988; to bumper standards under the Motor Vehicle Information and Cost Savings Act of 1972, which became effective in 1978; and to air pollution control standards under the Clean Air Act of 1968, as amended in 1977, and 1990.

 

If vehicles manufactured abroad conform to U.S. safety, bumper, and emission standards, it is because these vehicles are exported for sale in the United States. Therefore, it is unlikely that a vehicle obtained abroad meets all relevant standards.

 

Vehicles entering the United States that do not conform with U.S. safety standards must be brought into compliance, exported, or destroyed. This pamphlet provides essential information for U.S. residents, military or civilian government employees, and foreign nationals who are importing a vehicle into the U.S. It includes U.S. Customs and Border Protection (CBP) requirements and those of other agencies whose regulations we enforce. Since Environmental Protection Agency (EPA) and Department of Transportation (DOT) requirements are subject to change, we recommend that you contact these agencies before buying a vehicle abroad.

Documents Required:

For CBP clearance you will need the shipper’s or carrier’s original bill of lading, the bill of sale, foreign registration, and any other documents covering the vehicle. You will also be required to complete EPA form 3520-1 and DOT form HS-7, declaring the emissions and safety provisions under which the vehicle is being imported. Vehicles that meet all U.S. emission requirements will bear manufacturer’s label on the engine compartment in English, attesting to that fact. For vehicles that lack such a label, the CBP inspector at the port of entry may require proof of eligibility to import under the EPA exemptions or exclusions specified on form 3520-1.

 

Vehicles that do not meet all U.S. emission requirements, unless eligible for exemption or exclusion must be imported through an independent commercial importer (ICI). EPA will not allow the vehicles’ release to the vehicle owner until ICI work is complete. The ICI will perform any EPA-required modifications and be responsible for assuring that all EPA requirements have been met. Some vehicles cannot be successfully imported or modified by an ICI, however, and in general, ICI fees are very high.

Duties and Taxes:

Foreign-made vehicles imported into the U.S., whether new or used, either for personal use or for sale, are generally dutiable at the following rates:

Duty rates are based on price paid or payable. Most Canadian-made vehicles are duty-free.

Importing a Vehicle:

The Clean Air Act prohibits importation into the United States of any motor vehicle, motor vehicle engine, nonroad engine and equipment that does not conform to United States EPA emission standards and requirements.

Importation of Vehicles Over 21 Years Old - The EPA has long interpreted the equivalence requirement to mean that the engine must be identical to the engine that was originally installed. Such an engine is one that is the same model and configuration as the original engine.

Circumstances in which nonconforming vehicles can be import:

By Certification- Nonconforming vehicles can be imported, if they are modified, tested and certified by an Independent Commercial Importer (ICI).

By Exemption- EPA regulations also allow nonconforming vehicles and engines to be temporarily imported under United States Customs bond, if they qualify for an EPA exemption.

Safety, Bumper, and Theft Prevention Standards:

Importers of motor vehicles must file form HS-7 at the time of vehicle is imported to declare whether the vehicle complies with DOT requirements. As a general rule, motor vehicles less than 25 years old must comply with all applicable Federal Motor Vehicle Safety Standards (FMVSS) in order to be imported permanently into the United States. A vehicle must be imported as a nonconforming vehicle unless it bears the manufacturer’s label certifying that it meets U.S. standards. If it is a nonconforming vehicle, the importer must contract with a DOT-registered importer (RI) to modify the vehicle and certify that it conforms to all applicable FMVSS.

Federal Tax:

Certain imported automobiles may be subject to the gas-guzzler tax imposed by section 4064 of the Internal Revenue Code. An individual who imports an automobile for personal use, or a commercial importer, may be considered an importer for purposes of this tax and thus liable for payment of the tax.

Emission Standards:

The following passenger cars, light-duty trucks, heavy-duty engines and motorcycles are subject to federal emission standards:

Gasoline-fueled cars and light-duty trucks originally manufactured after December 31, 1967.

Vehicles must be certified to U.S. federal emission standards by their manufacturers for sale in the U.S. Vehicles that do not meet these requirements are considered nonconforming.
